Judge Clarence Thomas of the Supreme Court said in his consent Overturn the Roe v. Wade case On friday, that court Need to rethink Cases involving reproduction, LGBTQ +, same-sex marriage rights.

Thomas acknowledged that the decision to overturn the Roe v. Wade case applies only to abortion, but argued that the due process provisions of the Constitution do not provide the right to abortion or any other substantive right.

Specifically, Thomas wrote that the court should reconsider references to “substantive due process precedents, including Griswold, Lawrence, and Obergefell,” a major judgment. Includes reproduction, LGBTQ +, and citizens’ rights..

  • Griswold vs Connecticut Determined in 1965, it gave the couple the right to contraception without government intervention. This ruling presumed right to privacy and played a role in using right to privacy when including LGBTQ +, contraceptive and abortion rights.
  • Lawrence v. Texas Decided in 2003, the sodomy law prohibiting same-sex sexual activity has been revoked across the country.
  • Obergefellv. Hodges It was a groundbreaking decision in 2015 that gave same-sex couples the right to marry. This decision was a 5-4 decision with the current Supreme Court. Judges Thomas and Samuel Alito disagree.

In the draft opinion on the overthrow of the Roe v. Wade case, Leak in MayArito said he rejected the assumption that his reasoning applies only to abortion and that the decision could apply to Griswold, Lawrence and Obergelfell.

“In this opinion, nothing that casts doubt on cases unrelated to abortion should be understood,” Arito wrote.
