MAKKAH: The Saudi Supreme Court’s First Circuit Court of Appeals overturned all judgments in the 2015 Al-Haram Crane case and ordered a retrial.
The incident took place on December 11, before the Mecca pilgrimage season. The crane involved in the Grand Mosque expansion project collapsed, killing 110 people, injuring 209 and damaging the Grand Mosque in Macca.
The Supreme Court has ordered a new judicial circuit to review the case. Defendants, the Court of Appeals and the competent authorities are informed of the decision.
The move included the revocation of a previous acquittal issued by the Criminal Circuit in the Court of Appeals a year ago. The case will be transferred to a new judicial circuit court for review by a new judge.
Legal adviser Dr. Mohammed bin Abdulaziz al-Mammoud said the decision “confirms the independence of the judiciary” and “supervises by the higher judiciary authorities represented by the Supreme Court.”
He added that its authority was “not the court of judgment in the proceedings, but the body of complaints against the court that issued the disputed judgment.”
Al-Mahmoud said: “We will consider the judgment in terms of the correct application and interpretation of the laws and regulations, and the procedures followed in the trial.”
He told Arab News that the Supreme Court, in accordance with the text of Article 181 of the Code of Criminal Procedure, pointed out flaws in the judgment’s reasoning and lack of comprehensive reasoning, and lack of investigation into those accused of negligence. .. ..
“If they are liable in accordance with Article 19 of the Code of Criminal Procedure, they must be held liable,” he said.
After the incident, King Salman ordered each family of the deceased to pay 1 million SR ($ 266,666) and the seriously injured to pay 500,000 SR.
However, that compensation does not preclude the judicial claim of individual rights, as stated in the King’s order issued at the time.
