The Tamil Nadu Government has completed at least 10 years’ imprisonment and has developed guidelines for the early release of prisoners who are eligible to be released.

It is under the government’s authority to commutate, commute, or remit prisoners’ sentences under Article 161 of the Constitution. However, the government has specified 17 disqualification criteria, of which those convicted of joint / religious crimes are not eligible for early release.

MH Jawahirullah, leader of the Tamil Nadu Muslim Munnetra Kazhagam (TMMK) party, said several Islamic prisons were not released by the government for the past decade, even though several courts said they were eligible for release. He said there were Muslim prisoners. Many Muslim prisoners spend their youth in cells and suffer without parole.

TMMK leaders said about 20 prisoners had certificates suitable for release, but the government refused to release them after spending more than 20 years in prison.

In 2008, the Tamil Nadu government released about 1,400 prisoners who had spent more than seven years in prison, but not Muslim prisoners. And in 2018, to commemorate the 100th anniversary of the birth of former Prime Minister MG Ramachandran, the government released 1,627 people, but no Muslim prisoners were among them. About 700 prisoners were released in 2021, but Muslims were again discriminated against.

The Tamil Nadu Government has formed an advisory board under the Prison Manual to release prisoners who have spent more than 14 years in prison on bail. According to prisons, manual prisoners can be considered immature if they are over 65 years old or if they are medically invalidated prisoners. Similarly, prisoners who have spent three to three years in prison are entitled to 15 days of parole in a year without escort. However, all these privileges granted to prisoners have been denied to Muslims.

Note that 60 innocent Muslim prisoners were released after 10 to 15 years of prison distress because the court did not prove accusations against them. Tamil Nadu has 6% of the Islamic population, about 17% of Islamic prisoners and 16% on trial.
